Fluid Color LLC warrants to the end-user customer that Fluid Color LLC products will be free from defects in material and workmanship for two years from the date of installation and/or during the period for which an extended service maintenance agreement (SMA) was purchased. For Warranty Labor, coverage extends one (1) year from the date of printer installation and/ or during the period for which an extended SMA was purchased.

For software products, Fluid Color LLC's limited warranty applies only to a failure to execute programming instructions.

Fluid Color LLC does not warrant that the operation of any product will be uninterrupted or error-free.

Fluid Color's limited warranty covers only those defects that arise as a result of the normal use of the product and does not cover any other problems, including those that arise as a result of (i) improper maintenance or modification; (ii) software, media, parts or supplies not provided or supported by Fluid Color LLC; (iii) operation outside the product's specifications; or (iv) unauthorized modification or misuse.

For Fluid Color LLC printers, the use of a non-Fluid Color ink will void the warranty on the entire ink delivery system, furthermore, if printer failure or damage is attributable to the use of a non-Fluid Color LLC ink, Fluid Color LLC will charge its standard travel, time and materials charge to service the printer for the particular failure or damage.

For Fluid Color LLC printer ink, this warranty does not apply to products that (i) have been tampered with in any way, (ii) experience problems resulting from misuse, improper storage, or operation outside of the published environmental specifications for the printer product or (iii) exhibit wear from ordinary use.

If Fluid Color LLC receives, during the applicable warranty period, notice of a defect in any product that is covered by Fluid Color LLC's warranty, Fluid Color LLC shall either repair or replace the product, with a new or comparable rebuilt product at Fluid Color LLC's option.

Any replacement product or part may be either new or refurbished, provided that it has functionality at least equal to that of the product being replaced.

Warranty replacement shall not extend the warranty period of the defective product. This warranty shall not extend to consumables such as but not limited to; customers' material/substrate, and parts that need to be replaced due to normal wear (ie. filters, mercury halide lamps), as to which there shall be no warranty or replacement.

Print heads are not considered consumable items. They are covered under Fluid Color LLC's standard warranty for one year with these exemptions: (i) "process color" heads are only covered under this warranty. This includes cyan, magenta, yellow, black, light cyan, light magenta, orange, and violet. This warranty does not cover white or varnish heads; (ii) heads are not warranted against operator negligence. Le. catastrophic head strike, damage from placing the wrong color ink in the wrong ink feed system, lack of proper daily maintenance, etc.; (iii) use of non-Fluid Color LLC ink voids the head warranty. At the end of the one-year head warranty, customers will be able to purchase heads at a 50% discount from MSRP for a period to include the balance of the machine warranty.

At a customer's request, a print head can be returned for evaluation to determine the specific cause of failure and potential recovery. However, no guarantee can be made, and may result in the destruction of the printhead.

For any part to carry or continue to carry a valid warranty the replacement of any part must be installed by a CERTIFIED Fluid Color LLC technician. A Fluid Color LLC certified technician can only be dispatched by Fluid Color LLC. Any damages caused by parts being installed by a NON-certified Fluid Color LLC technician and or a technician not dispatched by Fluid Color LLC will not be warranted and resulting repairs will be billed at four (4) times the normal labor rate to return the printer to an operational state.

If any printer that is under warranty has repairs or replacement parts installed by a NON-Certified Fluid Color LLC technician, the printer's warranty shall become null and void immediately.

Fluid Color LLC's Limited Warranty Statement is valid in any country where the covered Fluid Color product is distributed by Fluid Color LLC. Contracts for additional warranty services, such as on-site service, may be available from any authorized Fluid Color dealer in countries where the product is distributed by Fluid Color LLC or by an authorized distributor.

Limitations of Warranty
TO THE EXTENT ALLOWED BY LOCAL LAW, NEITHER FLUID COLOR LLC NOR ITS THIRD-PARTY SUPPLIERS MAKE ANY OTHER WARRANTY OR CONDITION OF ANY KIND, WHETHER EXPRESS OR IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, AND FITNESS FOR A PARTICULAR PURPOSE.

Limitations of Liability
To the extent allowed by local law, the remedies provided in this Limited Warranty Statement are the customer’s sole and exclusive remedies.

Except where prohibited by law, FLUID COLOR LLC SHALL NOT UNDER ANY CIRCUMSTANCES BE LIABLE TO PURCHASER OR USER FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, LABOR, MATERIAL CHARGES, LOSS OF PROFITS, REVENUE, BUSINESS, OPPORTUNITY, OR GOODWILL) RESULTING FROM OR IN ANY WAY RELATED TO SELLER’S PRODUCTS, SERVICES. This limitation of liability applies regardless of the legal or equitable theory under which such losses or damages are sought including breach of contract, breach of warranty, negligence, strict liability, or any other legal or equitable theory.

Local Law
This Limited Warranty Statement gives the customer specific legal rights. The customer may also have other rights which vary from state to state in the United States, from province to province in Canada, and from country to country elsewhere 11272023 Fluid Color Limited Warranty Statement 4 in the world. To the extent that this Limited Warranty Statement is inconsistent with local law, this Statement shall be deemed modified to be consistent with such local law. Under such local law, certain disclaimers and limitations of this Warranty Statement may not apply to the customer. For example, some states in the United States, as well as some governments outside the United States (including provinces in Canada), may: (i) preclude the disclaimers and limitations in this Warranty Statement from limiting the statutory rights of a consumer (e.g., United Kingdom); (ii) otherwise restrict the ability of a manufacturer to enforce such disclaimers or limitations; or (iii) grant the customer additional warranty rights, specify the duration of implied warranties which the manufacturer cannot disclaim, or allow limitations on the duration of implied warranties.

THE TERMS IN THIS WARRANTY STATEMENT, EXCEPT TO THE EXTENT LAWFULLY PERMITTED, DO NOT EXCLUDE, RESTRICT, OR MODIFY, AND ARE IN ADDITION TO, THE MANDATORY STATUTORY RIGHTS APPLICABLE TO THE SALE OF THE FLUID COLOR LLC PRODUCTS TO SUCH CUSTOMERS.
